DMCA Policy

Paramanand Tech ("we," "us" or "our") respects intellectual property rights and responds to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. section 512. This policy describes how copyright owners and users should submit notices and counter-notifications.

1. Policy overview

Paramanand Tech hosts marketing content, creative assets and user-generated materials submitted by publishers and advertisers. We are not responsible for monitoring all materials but will act on valid DMCA notices regarding content stored on or linked through our Platform where we have the ability to remove or disable access.

Submitting false or bad-faith notices may result in liability under 17 U.S.C. section 512(f).

2. Designated agent

Email is the preferred method for fastest processing. Physical mail may experience delays.

3. Takedown notice requirements

To be effective under the DMCA, your written notice must include:

• Identification of the copyrighted work you claim has been infringed, or a representative list if multiple works are covered by a single notification
• Identification of the material claimed to be infringing, with sufficient detail for us to locate it (URLs, account IDs, campaign names, screenshots)
• Your contact information: full name, mailing address, telephone number and email address
• A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent or the law
• A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf
• Your physical or electronic signature

Incomplete notices may not be processed. Include all requested elements in a single communication.

4. Our process

Upon receipt of a valid DMCA notice, Paramanand Tech may:

• Remove or disable access to the identified material
• Notify the user who posted the material with a copy of the notice
• Document the complaint and retain records as required by law

We aim to acknowledge notices promptly and take appropriate action within a reasonable timeframe. Complex cases involving third-party landing pages may require additional coordination with advertisers or publishers.

5. Counter-notification

If you believe material was removed or disabled by mistake or misidentification, you may submit a counter-notification to our DMCA agent containing:

• Your physical or electronic signature
• Identification of the material that was removed and its location before removal
• A statement under penalty of perjury that you have a good-faith belief the material was removed due to mistake or misidentification
• Your name, address, telephone number and consent to jurisdiction of the federal district court for your address (or, if outside the U.S., any judicial district in which Paramanand Tech may be found), and that you will accept service of process from the person who submitted the original notice

After receiving a valid counter-notification, we may restore the material in accordance with DMCA timelines unless the copyright owner files a court action seeking to restrain the user from engaging in infringing activity.

6. Repeat infringers

Paramanand Tech maintains a policy to terminate, in appropriate circumstances, accounts of users who are repeat infringers. A repeat infringer is any account holder for whom we have received more than one valid DMCA notice of infringement. Termination decisions consider the severity, frequency and good-faith cooperation of the user.

7. Misrepresentation

Any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages including costs and attorneys' fees under 17 U.S.C. section 512(f). Consult legal counsel before submitting a notice or counter-notification if you are uncertain about your rights.
